New NLRB Policies Regarding Immigrant Employees

In a recent memorandum to National Labor Relations Board (NLRB) field offices, General Counsel Jennifer Abruzzo rolled out new policies to ensure protections for immigrant workers in order that they can exercise their rights under the National Labor Relations Act (NLRA) without retaliation.

The NLRB has instituted new procedures that will allow the Agency to more effectively serve the needs of immigrant communities. The new policies are designed to ensure that the NLRB provides services to all workers who seek the NLRB’s assistance without regard to immigration status or work authorization.

Ms. Abruzzo, nominated by President Biden in February 2021 and sworn in in July 2021 states: “In order for all workers to be able to exercise their rights under the Act, we must zealously guard the right of immigrant workers to be free of immigration-related intimidation tactics that seek to silence employees, denigrate their right to act together to seek improved wages and working conditions, and thwart their willingness to report statutory violations… I am resolved to hold fully accountable those entities that, by targeting immigrant workers and their workplaces, undermine the policies of the NLRA and the nation’s immigration laws.”

The memorandum instructs regions to fully and immediately seek remedies regarding immigration-related threats and retaliatory conduct in unfair labor practice cases.
